Pennsylvania Foreclosure Law and Process

This page will tell you about the Pennsylvania foreclosure law.
The first major thing that you must know about the
PA foreclosure
law is that we are in a judicial state.
What that means is there
is a process through the court system that your mortgage company
MUST go through in
order to take your house back via foreclosure proceedings.
Ok so now what? How does the Pennsylvania foreclosure law
work from here.......
- You're bank can't start the foreclosure process until you
are at least 60 days late.
- They, of course, will send you letters and some may even
try to
call you to remind you to make your payment before the foreclosure
process starts and they take your house.
- After 60 days late, they will send you a letter to the
effect
that they are beginning the foreclosure process. In this
letter,
they will also tell you ways you can AVOID the
foreclosure. Also, in this first letter you will receive what
is called the Act 91 Notice. Act 91 is the Homeowner's
Emergency Mortgage Assitance Program (HEMAP.)
This is government help to stop foreclosure. This a state
funded
program that you must qualify for. It's definitely
worth
checking out.
- You will now be given roughly 2 to 4 months to try to
prevent the
foreclosure. I say roughly, because it really varies from
mortgage company to mortgage company. Some take their sweet
time
and move slower than molasses and some are very much on the ball and
move very quickly.
- After this time fram (2 to 4 months) if you still have not
managed to find a way to avoid the foreclosure process then your
mortgage company will file a lawsuit against you for the ENTIRE balance of
your loan (not just the payments you are behind.)
- You will be notified via mail or in person.
- Now, you have roughly 20 days to respond to this lawsuit,
otherwise the judge will order your house to be scheduled for sheriff's
sale.
You can Avoid your foreclosure and stop it at any time, even the day of
the pending sheriff's sale if you are able to bring the loan current.
Always remember that, so if you can get help from HEMAP or
from
family or friends, it's definitely worth a shot. And most

- The sheriff will give you at least 30 days notice of the
sale of
your property. You will usually see the handbill that he/she
posts on your front door and they'll mail you a copy of the notice as
well.
- The sale of your property is also advertised in a local
paper and a legal paper.
- The sale may be postponed one time for up to 100 days after
that a court order is required to postpone the sale any further.
